In the USA the Consumer Product Safety Commission ensures the safety of consumer products including compliance with the Labeling of Hazardous Art Materials Act (LHAMA).

To sell your art materials and related products in the USA they must first undergo a toxicity risk assessment carried out by a Certified Toxicologist. SGS’s LHAMA testing service delivers LHAMA and TRA testing.

LHAMA testing and labeling is required for items including, but not limited to:

  • Paints
  • Crayons
  • Colored pencils
  • Glues
  • Modeling clay

The Act requires you to review all art materials to determine the potential for causing a chronic hazard and is applicable to all art materials. It is not limited to children’s products. To ensure consumer safety you must consider the potential for harm from exposure to art materials. This includes reasonably foreseeable use, or misuse, as well the likely exposure routes:

  • Inhalation
  • Ingestion
  • Skin and eye contact
  • Other contact

Materials with the scope to pose a chronic hazard must then be given appropriate warning labels, to help protect consumers.
